Terms of sale.

These Terms of Sale apply to every order placed on understoryplant.shop (the "Site"), operated by Understory Plant LLC, 1812 SW 23rd St #B, Fort Lauderdale, FL 33315. By placing an order you agree to them.

1. Orders

Your order is an offer to buy. We accept it when we send a shipping confirmation. We may refuse or cancel an order, for example if an item is out of stock, a price was listed in error, or we suspect fraud. If we cancel after you have paid, we refund you in full.

2. Live plants

Plants are living things, and each one is unique. Size, leaf count, color and variegation will vary from the photos, which show a typical plant of the listed size. Sizes describe the nursery pot diameter and the approximate total height, measured from the base of the pot. Live plants ship only to the 48 contiguous states and DC because of agricultural rules for Alaska and Hawaii.

3. Prices and payment

All prices are in US dollars. The price charged is the one shown when you place your order. We collect sales tax on orders shipped to Florida. Payment is taken when you place your order and is processed by Stripe; see our Privacy Policy. We accept Visa, Mastercard, American Express, Discover and Apple Pay.

4. Shipping and weather holds

Plants ship Monday to Wednesday. If forecast temperatures along the delivery route are dangerous for plants, we may hold your order for up to seven days and will email you if we do. Title and risk of loss pass to you on delivery to the carrier, but our Arrive-Alive guarantee still applies. See Shipping & guarantee.

5. Arrive-Alive guarantee and returns

Our guarantee and return policy are described on the Shipping & guarantee page and form part of these terms.

6. Plant toxicity and use

Pet-safety information on the Site is based on the ASPCA's published toxic and non-toxic plant lists and is provided for general guidance. Keep all plants out of reach of small children and pets, and contact your veterinarian or doctor if you suspect ingestion.

7. Limitation of liability

To the fullest extent permitted by law, our total liability for any claim relating to a product is limited to the amount you paid for that product. We are not liable for indirect or consequential damages. Nothing in these terms limits any rights you have under consumer protection laws that cannot be waived.

8. Governing law

These terms are governed by the laws of the State of Florida. Any dispute will be heard in the state or federal courts located in Broward County, Florida, unless the law of your state requires otherwise.
